Institute of Indian Jurisprudence (www.iij.org.in) :
Institute of Indian Jurisprudence was founded on 01-01-2014 in Guwahati. 
Justice Shrimoti Anima Hazarika, Retired Judge of the Gauhati High Court, D.C. 
Mahanta, Senior Advocate of the Gauhati High Court, Prof. R.C. Borpatra Gohain, 
now Dean of the Faculty of Law, Gauhati University, Dr. L.P. Thakuria, 
Advocate, Gauhati High Court and Dr. B.C. Barua, Principal, Tezpur Law College 
were the founding fathers of this Institute.

This is an institute which studies not only Indian Law and the Constitution, 
but also the Indian State System. So it is an unique institution of Indian 
State, Law and the Constitution.

The Institute publishes a quarterly journal-“The Indian Jurist”. Dr. L.P. 
Thakuria is the Editor. The last issue of this journal was published in 
December, 2015 which was a special issue published on the occasion of the Birth 
Centenary  of Justice V.R. Krishna Iyer.

The Institute, by a resolution adopted on the occasion of the Birth Centenary 
of Justice Iyer resolved:
“Justice Krishna Iyer taught us to interpret the Indian Law and the 
Constitution with an approach of Socialist Humanism. This is his greatest and 
noble teaching and we solemnly resolve to follow his teaching in carrying out 
our day to day activities.”

Justice Anima Hazarika, Chairperson of the Institute, in her column in the last 
page of the journal “The Indian Jurist” in its first issue in February, 2014, 
under the title “The Vision and Mission of Institute of Indian Jurisprudence” 
wrote-“The Institute shall particularly focus on Development Jurisprudence, 
though not to the exclusion or detriment of the other branches of jurisprudence.

On December 1986, the General Assembly of the United Nations adopted the 
Declaration on the Right to Development. The Government of India is a signatory 
to this declaration. The Supreme Court in two cases viz., Madhu Kishwar & 
others –Vs- State of Bihar (1996) 5 SCC 125 and Samathe –Vs- State of Andhra 
Pradesh and others (1997) 8 SCC 191, have declared the people’s right to 
development as a fundamental right. However, there is very little awareness 
among people and the government about the right to development in the present 
era of globalization. We, therefore, intend to carry out research and training 
on this new and exciting branch of Indian Jurisprudence in the near future.”

D.C. Mahanta, Senior Advocate and a lawyer of 83 years of age, the present 
Chairperson, wrote in the 5th issue of the journal in its column on last page 
of the issue, April-August, 2015 of the Indian Jurist:
“We oppose the Neo-liberal State vehemently. We disdain to conceal our views so 
far as the issue of globalization, liberalization and privatization are 
concerned. The Indian Neo-liberal State entails reverting back to the free 
market from welfare state even more forcefully. Today, the Neo-liberal State in 
India negotiates between predatory profits making interest of global financiers 
and legitimate right of the Indian citizens. The necessary metamorphosis of the 
Indian Neo-liberal State is the consequence of tensions and frictions of these 
two opposites and as the Neo-liberal Indian State undergoes the process of 
metamorphosis the “Structural Inequalities” get entrenched, permeated and 
engrossed favour of CLASS INTEREST OF THE GLOBAL FINANCIAL CAPITALISTS.

In this unequal fight, we side with the crores of poor Indian citizens by 
waging an ideological fight against the State power of Indian Corporate 
Bourgeoisie. This is our mission.”

The “Development Jurisprudence” initiated by the Institute of Indian 
Jurisprudence is a new discipline based on the Economic Philosophy of the 
Constitution of India. It is a travesty of truth that the Constitution of India 
does not have an economic philosophy of its own. We will endeavor to prove that 
the Constitution of India does have an economic philosophy of its own and we 
will interpret the same in our present investigation in “Indian Development 
Jurisprudence”.
