An ordinance bringing the new quota system into effect will be promulgated immediately. The Cabinet on Friday accepted the recommendation of AP Commission for Backward Classes for the five per cent quota and said it would be under a new category called E, and will be in addition to the 25 per cent of seats reserved for A, B, C and D categories of backward classes. In some states Muslims get quota protection in jobs and education but not because of their religion. Quotas are granted to Muslims who fall under the category of backward. Information and public relations minister Md Ali Shabbir told reporters after the Cabinet meeting that ministers had decided to apply creamy layer formula followed by the Centre -- in case of Backward Class reservation -- to Muslims here. This would be in accordance with the direction of the high court, which wanted creamy layer among Muslims to be separated before providing reservation. The current criterion followed by the Centre for defining creamy layer among BCs is Rs 2.5 lakh annual income of parents. Children of Class I and II officers in the government are also not eligible for the benefit. The minister said that the Cabinet had rejected the BC commission's recommendation to bring Pinjari, Dudekula, Ladaf, Nurbasha and Mehtar communities of Muslims who were enjoying reservation under A, B, C and D categories under the new 5 per cent quota. "This was done to prevent possible legal complications," Shabbir said. The minister, while stating that the 5 per cent quota for Muslims would take the total percentage of reservations in the state to 51, said that it would not pose any legal problems as the Supreme Court had observed in the Indira Sawhney case that reservations could go beyond 50 per cent if the government was able to show justification for it. Even states like Tamil Nadu had 69 per cent of total reservations.
