Technically digium doesnt own all the copyright. They own a trademark on the name 'asterisk' and they own some of the copyrights. What they have is carte blanche on licensing. The disclaimer does not assign copyright to digium, the individual coders still own that (and they can do whatever they personally want with their code), however they gave digium the right to license any contributions any way digium sees fit.
