Well, how many INVITE are being sent to the phone? If it receives the second one, it will report a busy.
This sometimes happens when a user agents has a dangling registration and the SIP proxy does call forking. However, in this case the 2nd reject will not be propagated to the user agent client (RFC3261). A SIP trace of the phone will reveal this situation.
