My question was referring to the fact that Asterisk MoH cannot handle variable bit rate MP3 at this time. So I am under the impression that I have to modify my MP3 that I want to use for MoH to be at a constant bitrate for MoH to work properly.

mpg123 will do variable bit rate and output it at 8kbs. It may not like some of the frames that are encoded on some mp3s but being vbr is in itself not a problem from my study of the situation.
