If the developer of a game hasn't said its distribution is legal, then it still isn't. Copyright laws don't give a crap if a product is out of print or not. Copyright is still copyright even if the developer has stopped supporting it. So from a pure question if whether it is illegal or not, yes, it most certainly is. I'm not saying whether I agree with it or not, I play emulated games on occasion myself. But from a pure legal standpoint, yes, this is considered piracy.
