First, as long as your fs is not aufs, the problem is out of aufs I am
afraid.
Next, generally the system shutdown script should make the root
filesystem readonly with "-n" option. But I don't think the lack of this
option is related to your problem.
Finally I am unsure what makes your /(root) busy.
