Not exactly sanity. The 40nm requirement was a temporary requirement and
was to be removed during one of the later stages of NAS implementation. It
was a temporary measure to get some parties to agree to the NAS changes
which were intended to end up with North American airspace organisation.
Now that that has been stopped it is only reasonable that the requirement
be dropped.
