Yes but if the custoer has technical resources then it is not a crime for them to make a test copy and attempt the upgrade. If there is minimal modifications (which is always the aim of a good partner) then it is possible they do and there is no harm them trying but you are right to highlight it might now be an easy task depending on what has already been modified.
