They did, but not until after the Guardian had passed. They didn't do
so previously because Shoghi Effendi never told them to.

It was up to him to decide when and how the provisions of the W&T
would be implemented., For instance, the W&T states that the Hands
expel people from the Cause but during the Guardian's lifetime he
assumed that power himself. He also decided to postpone the election
of the House of Justice.

  That the nine were never elected suggests to me Shoghi Effendi

Yes, probably because he did not yet have anyone to appoint as a
successor. I say 'yet' because Pilgrim's Notes indicate to me he still
had hopes.
