They did, but not until after the Guardian had passed. They didn't do so previously because Shoghi Effendi never told them to. I thought Shoghi Effendi was bound by the Will > and Testament, or was the authority it gave him such that he could override > parts of it? It was up to him to decide when and how the provisions of the W&T would be implemented., For instance, the W&T states that the Hands expel people from the Cause but during the Guardian's lifetime he assumed that power himself. He also decided to postpone the election of the House of Justice. That the nine were never elected suggests to me Shoghi Effendi > did not want the election. Yes, probably because he did not yet have anyone to appoint as a successor.
