  Senator Says 2005 Law Prohibits U.S. Release of Gitmo Detainees

Detainees being held by the U.S. at Guantanamo Bay, Cuba may be 
prohibited from release in the United States under a 2005 law, according 
to a Republican senator who is raising the issue with the Justice 
Department.

In an April 2 letter to Attorney General *Eric Holder*, Alabama Sen. 
*Jeff Sessions *expresses concern that as a result of President *Barack 
Obama*'s order to close the Guantanamo Bay prison within the next year, 
some of the prisoners held there may have to be released in the U.S.

Holder last month noted that possibility as part of the review of the 
detainee cases and discussions with foreign allies who the U.S. hopes 
will help resettle those detainees who are considered eligible for release.

The most dangerous detainees are expected to be tried, perhaps in U.S. 
civilian courts, or a retooled military judicial system or in other 
jurisdictions.

Among those whose release is being reviewed are 17 ethnic Uighurs who 
are wanted by Chinese authorities who consider them to be members of a 
separatist group.

"I would oppose any release of trained militants or terrorists into the 
United States," Sessions writes. "Such an action would be contrary to 
national security interests, as well as federal law."

A Justice Department spokeswoman didn't have any immediate comment on 
the letter and wasn't sure it had yet been received.

Holder said in an interview with the Wall Street Journal on Thursday 
that he understood concerns being raised as a result of the Guantanamo 
closure and other reversals of the Bush administration's national 
security policy but said Americans should be assured "we're not going to 
put the country at risk."

Conversely, he said, it was some of the policies, including indefinite 
detention of terror suspects, that had done "damage" to the U.S., had 
made it difficult to work with allies and "ultimately made us less safe."

Sessions cites a 2005 change in federal law that banned the admission to 
the U.S. of "any alien who had engaged in various forms of terrorist 
activity or training."

He said that the Uighurs were known to have received training at camps 
in Afghanistan run by the Eastern Turkistan Islamic Movement, and that 
other detainees at Guantanamo should be deemed inadmissible because of 
similar training.
