This does not seem to be a MailScanner issue like i suspected, and the fix is
very easy.
mkdir /var/lock/subsys
And the service runs normally, anyway am not ubuntu/debian in production just
setup a
quick test machine to debug the issue and that fixes it for me. Please test and
let me
know.
