There really is not a clear definition of what constitutes a "motor" versus 
"motor-assisted." Does the presence of pedals on the vehicle and a clear 
demonstration that the electric motor is not the sole source of energy for 
propulsion exclude an electric bicycle from the state statutes? What is a 
motorized scooter? And be careful not to be too discerning about "high-powered" 
bicycles when rat racers on the Southwest bicycle path or the John Nolan bike 
path can exceed traffic speeds in the presence of pedestrians.

Sounds like it depends upon whether you’re talking about changing local 
ordinance or state law, and whether the SW Path, Cap City Trail, etc. are in 
fact “Bicycle Ways.”

C. Municipalities May NOT Permit Operation of Motor Vehicles on Bicycle Ways.
Section 349.23, Wis. Stats., generally permits local authorities to establish 
bicycle ways and to designate
what types of vehicles may operate on the bicycle way so long as the use is not 
inconsistent with bicycle
safety. That authority is subject, however, to the general requirement that any 
municipal traffic ordinance
not conflict with the traffic code. s. 349.03(1), Wis. Stats. In the case of 
bicycle ways, s. 346.94(12)
explicitly prohibits motor vehicle operation. This prohibition extends to 
motorized scooters, which are
motor vehicles:
346.94(12) Driving on bicycle lane or bicycle way. No operator of a motor 
vehicle may
drive upon a bicycle lane or bicycle way except to enter a driveway, to merge 
into a
bicycle lane before turning at an intersection, or to enter or leave a parking 
space located
adjacent to the bicycle lane or bicycle way. Persons operating a motor vehicle 
upon a
bicycle lane or bicycle way shall yield the right-of-way to all bicycles and 
electric personal
assistive mobility devices within the bicycle lane or bicycle way.

I would agree on the Atwood issues, being a long-time user (25+years) of the 
Atwood/Monona drive corridor. I'd also like to raise another issue that I've 
become aware of with in the last month. Apparently there is an effort under way 
to redifine qualified users of bike paths (and lanes, etc.) so that electric 
bikes can be used under power. I have MANY issues with this, not the least of 
which is the door it opens for gas-powered scooters (mopeds) to be used in 
these 
venues. Does anyone have any knowledge regarding this ?
