Yeah, I saw that. There are legitimate reasons for not using a bike lane:
debris in the lane, bad pavement, etc. making it unsafe to ride in the
lane. Someone might be parked in the lane, and you have to go around. On
Dayton I generally don't ride in the lane all winter because it is full of
snow/ice/salt/sand/all-of-the-above. Or if you are preparing to make a left
turn, but it doesn't sound like this rider was making a left and
transitioning to a turn position.

However, regardless of the reason one decides that riding in the lane is
unsafe or ill-advised, it is best not to rant at the police and assault an
officer if stopped. That's just generally a bad idea whenever dealing with
the cops.

And for those who may have missed it, there's a great video out there about
why riding in the bike lane might not be possible/safe. Made by a guy who
was ticketed in NYC for not staying in the lane.
