  As best as I understand copyright laws if you use the effects for 
  non-commercial use then one is allowed to use them. It becomes a big 
  issue when it is used for commercial games.
  As for Mario I seam to recall Nintendo Game Cube has a Super Mario game. 
  So I am sure Nintendo has been hanging on to that title and upgrading 
  for the platforms.
