Insofar as it has been passed person to person, as opposed to sent to 
random email addresses, I'd give it amnesty.  Although off-subject 
stuff on mailing lists is always borderline.

However identifying spam as "commercial" only is a big mistake.  You 
wouldn't believe how many people would love to spam you for 
non-commercial purposes.
