Regarding HB 1023, I wanted to point out that in the bill, page 3, the
intent of lines 7-8, according to our lobbyist, is to ensure that unless
nonoprofits are specifically prohibited by ordinance, rule, or law from serving
undocumented immigrants, this act wouldn't add any new prohibitions on their
services. We will also be getting an opinion about this language
from our county attorney, but I wanted to bring this to your attention.
This is the language that legislative leadership fought hard to retain, to
make sure that the bill's prohibition on services to undocumented persons didn't
extend to other services not specifically covered in the bill. (such as
nonprofit services, access to open space trails, library services, etc. that
don't currently have a prohibition to serving undocumented
persons)
