If Ashcroft had tried this, he would have
said the reporter illegally had secret/confidential
information, and was some kind of spy.  If you want
to include being held w/out access to a lawyer in
this imaginary story, he would have either used some
trick such as the "enemy combatant" one used for
Jose Padilla (an American citizen being held without
any trial, or access to a defense lawyer...) or
keep him under "protective custody" as a material
witness.

Regardless, he was held w/out lawyer for only 10
hours.  Would you find any administration officials to
come to his (the reporter's) defense in the way that
the European Ombusdman has?
