Firefox Sync is enabled in IceCat 38.3.0, here is how to verify it:

"Tools -> Set Up Sync..." opens about:accounts?entrypoint=menubar which first says "Continue", then "Create a Firefox Account to continue to Firefox Sync" (as long as LibreJS is disabled), otherwise it says "Firefox Accounts requires JavaScript.". However, the problem with Firefox Sync is that it is a cloud, not that it is uses non-free JS.

"Edit -> Preferences -> Sync" also appear.
