I have just had  a phone call from the BSS office in respect of this 
item.

The information the owner passed to Canal Boat and hence myself was 
not as full as it could have been. I understand the owner did not 
take a personal part in discussions with the examiner, leaving that 
to his agent who may or may not have accurately related the findings 
to the customer.

I am happy that the fridge was failed for a valid reason which no-one 
has mentiond on a public forum.

I am also happy that the fact that it was not room sealed did NOT 
cause the failure, BUT that fact, flue modifications and other things 
would have resulted in a number of advisory points which the owner or 
his agent may have decided to understand as a failure.

If a CE marked boat is sunbisquently fitted with a non-room selaed 
appliance some interesting legal questions arise.

If the failure items had been addressed on this boat and a pass, plus 
advisory notices had been issued any future accident may bring the 
insurance into question.

As far as I can tell the BSS examiner and the BSS office acted in a 
responsible andn proffessional way in thsi matter - its just that we 
were not given the full facts.

If anyone was out of order it was the fridge vendor who (in the light 
of Thetford's statement about not being approvd for marine use) 
probably committed an offence by passing it off as suitable.

I hope this straightens things out.
