Have a look at the upload function of the Wordpress Media Manager ( I use
phpxref a lot for this kind of work, see
http://www.phpxref.com/xref/wordpress/nav.html?index.html) perhaps you can use
the liblicense code to determine if media files have already license information
embedded in it. If not provide a user the option to set a default license for
its blog and use this automatically for all uploaded media. However this makes
the presumption that the author is always the rightsholder of the uploaded
media, which isn't the case. So you still need to show the user that the system
wants to add the default license or use the embedded license and ask if this is 
ok.

I'd prefer to include a link to the CC website as well with it, since the image
will not say very much about the conditions of a license nor will it be
understandable for less knowledgeable user who've not yet encountered the CC 
icons.

Yes, you can modify the Wordpress database, but before you do try to get a
'go-ahead' from the WP core committers so this solution you propose might be
part of the WP core, although its more likely that this should be implemented as
a plugin first. In that case I propose to create a new table and datamodel for
licensing that allows to license more than just media files, but also individual
posts and pages and perhaps more. Similar to the terms taxonomy.I would strongly
advise to to use the database and not a file.

Do you plan on making this concept compatible with Wordpress Mu
(mu.wordpress.org)?
