As the director of the company, belive me when i say i can not take any risks. not with ooo, but with advertising.

I have checked with ebay that it is OK to use the term "compatible", and do not suggest this software is better than any other.
i have included the Microsoft Office is a trademark registered by Microsoft Co

because of this, I'm very confused, and of course very wary.

It really does sound like a case of malice, if this is the case then some one else is claiming copyright over this product.

ebay clearly states "
eBay Listing Removed: Unauthorised Copies (Copyright) "

They have not given me a clue as to who has claimed rights over this, but apparently i can ask?

We do actually do very well on ebay with this product, and it helps enhance our PC and laptop sales.

this weeks offer "Dell Pentium laptop bundle with new printer, camera and Office only £199"

we do of course show and state openoffice.org and describe it. though now it sounds like this could also be a possible risk

the fact that ebay are even entertaining the idea that distributing openoffice could be copyright infringement is a great concern.

All. and i mean All of our advertising is sceduled to supports this package (we want to give it away with everything "

to put this into perspective, i have just recieved a shipment of 10 thousand games and education CD's which are to be bundled with ooo for resale.

we have a large quantity of di-subliminal on silver  ooo cd on order pair up with them. So its a risk indeed, and its a great financial strain.

I cant belive ebay haven't heard of it or don't know about GNU / GPL , but someone really need to sort it out, ebay is a massive market place.
But the little guys seem to have more control over the distribution of this product than ooo itself.

I understand that little can be done.
thanks all the same
Stephen

1. Ebay can't and will not stop you from selling Openoffice.org. The only thing they prohibit is the comparison with Microsoft's products. For example you are not allowed to say "Openoffice.org is better than Microsoft Office". Also in every listing you have to underline that Microsoft Office is a trademark registered by Microsoft Co.

This happened to me as well. I had 10 Openoffice.org listings (identical) and only one was banned. I contacted live support and they said they were sorry, however the official Ebay support answered 2 days later with a vague email stating some rules for illegal copies...

In my opinion, what happened is that an ebay member, also selling Openoffice.org used other accounts to ruin you reputation. People like that, buy 100% feedback accounts for $100-$200 and use them to raise their feedback and lower their competitors'.

I 've seen listings on Ebay about Openoffice.org which seem aggressive at least. I would not be surprised if someone, tried to kill the competition.

The Openoffice.org community as far as I know is not into such things.

2. You also mentioned that you are waiting for a license. You have your GNU license, what are you waiting for ?

3. Ebay is the place to be anymore.... especially if you sell products like Openoffice.org. This suite and all the other open-source programs need the kind of marketing which will teach people the advantages of their use. Any profits will arrive from there but surely not from Ebay. The precentage you pay to Ebay for an Openoffice.org listing is huge and people aren't interested.

I advertise on ebay also sell from my shop and include with systems we sell.

today i had an email stating that i have infringed upon copyrights for this software (basically there saying that im selling unauthorized
copies).
exact line "
encourage or facilitate the infringement of copyrights, trade marks, or other intellectual property rights"

The product i distribute I'm proud of. We have them professionally duplicated and printed, then inserted into glossy labeled cd cases and finaly have them cellophane wrapped.
the end product is very professional and we give free backup to go with it.

I have used an advertising header that has been taken directly from ebays examples of "what is allowed" and they state in the few examples given that it is ok to use a line such as "Microsoft office compatible"

so, what is the problem.

Has openoffice.org truley made a report to ebay that im infringing on their copyrights?

I have signed up to all the requested things, filled in the right forms. listed myself "hasgot.com"

im logged in as a member "gehngus"

I have printed out the license/distribution agreement that states that i can assume i have the right to distribute while i wait for a reply (ive been waiting for 2 months)

can any one help?
the last thing i need is my company account being kicked off.

kindest regards
Steve

Don't have to.  We don't give away CDs.  You can however download it
from the mirrors (http://download.openoffice.org/index.html )  and burn
your own CDs or you can get pressed ones from some community
distributors for a reasonable fee.  For instance here: www.openoffice.org.nz
