The U.S. did not have a debt ceiling until 1917. Prior to that year, the U.S. merely guaranteed all of its debts. In the context of the current debt ceiling talks, some people oppose the use of the 14th amendment by Obama as justification for abolishing the debt ceiling rule by claiming that the prohibition to questioning public debt applies only to debts already incurred and on the books. Well, the Iraq war, the Afghan war, the Bush tax cuts, the Medicare prescription drugs, Medicare and Medicaid expenses, honoring the nation's debts to the Social Security trust funds, the nation's responsibility to finance its defenses - aren't these debts already approved by Congress and that the country is bound by law to honor these debts? All these debts, taken together, account for more than 70% of all U.S. debts. Obama, therefore, would be well within his rights to declare that all expenditures for previously approved entitlement and defense expenses, plus all debts used to finance a Federal government that the American people have time and again agreed to finance "shall not be questioned." I vote for Obama to just go before the American people and declare that all current and future debts arising from the conduct of government cannot be questioned. This will result in the abolition of the debt ceiling rule and bring us back to an America more in keeping with the Founding Fathers' intention. There's another issue here. The 14th amendment also states that Congress must see to it that the principles enunciated in the 14th amendment are not abridged. In other words, if Congress must insist that it alone has the power to determine the size of the public debt, it has a responsibility to approve debt ceiling increases if the debt ceiling must increase in order for the government to honor commitments already made. If Congress does not act, it would seem that it is in violation of the Constitution. Boehner and his cohorts in Congress could conceivably be sued before the Supreme Court for violating provisions of the 14th amendment.
