Subject: RE: Senate rejects move to ban same-sex marriage
Actually..
If currently the law supports Marriage between a man and a woman,
Then Gays are imposing their will if laws are changed to allow marriage
between
two men or two women.
Actually your sentence is a little too long. The law gives married couples
certain entitlements and benefits not avalaible to single persons. The law, as
currently written does not specify the gender of the couples other than via
traditon.
The defense of marraige act does specify gender as does a myriad of state
laws, however, many legal scholors do not think any of them will stand a
constitutional challenge as they are in conflict with the "Equal justice" clause
as well as the Bill of rights.. The latter is not law, but a statement of
intent which gave rise to the Constitution.
I don't think anyone other than the extreme religious right is trying to
impose anything on anyone, but are wanting to be treated equal under the law as
to entitlements, protection and benefits granted to married couples.
Now if the law was changed to remove all those entitlements, protections and
benefits, then the question would be moot as everyone would be treated equally
under the law. Since this is not the case, it is a justifiable assertion that
the law apply to everyone, not just a specific class. i.e. "Equal Justice,
under the Law."
My wife never asserted that our marriage was in any danger due to the lesbian
couple who lives next door, owns a home, is raising a teen-age boy and is
otherwise excellent neighbors.
