But you could get a lawyer (or lawyer friend ;)) to send a C&D letter
(cease and desist) or something to that effect.
They will either decide it is not worth their bother to even attempt a
comeback, and relinguish it in return for reg fees, or they will ignore
it.

It's awfully squirrelly out there when it comes to who has a right to
what.
If the site is not live and they are just sitting on it ... There's not
a whole lot you can do.
