Depends on your definition of a problem :) The most likely scenario for a conflict that would cause a split in the global DNS system is that some legal proceedings in the US would result in some court issueing some sort of restraining order that would force operators of the root servers to remove a certain domain name. For example, a conflict about a software patent were the infringing software is being distributed a .something incorporated and hosted somewhere in Europe. The only way for a US company to legally challenge that is in the US, because software patents are not valid in Europe. But since the infringing company has no assets in the US, there is no legal relief for them. So all the infringed company can do is get a court to order root operators to take down the infringing .something. But only US root operators have to follow a US ruling. What could happen in that case is that US root operators comply and others don't. In that case the ones that don't simply stop accepting any updates to the disputed hierargie and if changes are made to that hierargie these changes will not be visible. Eventually that would lead to different resolution of the disputed domain names depending on which root servers you are using. The other likely reason is that the US would want to remove a complete ccTLD for reasons of state security. Is this a problem? Maybe. Technically speaking, these are the same mechanisms as China and most of the Middle East are using to censor internet. The internet just routes around it and when the dust is settled only the country where the court order was issued, in these examples the US, has to deal with the lasting effects. The concern is the time and cost associated with the settling dust. Some consider that a problem.
