I think the more fundamental problem is that 'insurance' is not compatible with the way that healthcare functions.
What other type of insurance (besides health/dental) pays a claim for preventative measures? What other type of insurance do we sign up for with 99% certainty that we are going to file a claim? What other type of insurance collects a premium knowing with 100% certainty you are going to file a claim? Except for health insurance, all other forms of insurance protect the insured person (or that person's beneficiaries). Health insurance exists to protect doctors and hospitals from the risk of providing services without receiving payment. Surely you have noticed that health insurance claim payments never pass through your hands?? The power of the consumer is only relevant to elective services in which the consumer actually pays for it. If my wife needed an emergency C-section, I don't think I would drive all over town to find the hospital with the best price.
