Virginia has just been appealing their way up the food chain on a sodomy
case. It was MacDonald vs Virginia and prosecutors pushed for a sodomy
conviction, in spite of the Supreme Court having struck down such laws in
2003 in Lawrence vs Texas.

Cuccinelli has been pushing to keep their laws on the books and actively
prosecute and appeal such cases.

So, to answer your question....right now.
