That would depend on where you live actually. You have to be gay to get a single sex marriage here just as little as you have to be in love to get a mixed sex marriage. I think it would be most usefull to put classify relationships in a legal sense on the basis of whether they are one-to-one or one-to-many, and whether there is a form of financial dependence. I don't think single vs mixed sex should matter legally. That in practice only a subset of the mixed sex one-to-one relationships is called marriage is something for other institutions (like religious ones) to worry about.
