Arrested? I could see a lot of trouble, but surly this would be a civil case. They could sue the pants off you and send your finances back to the stone age making sure you never make a penny for yourself again. Doubly bad, since they can do this whether they win or not by just making the cost of Defending yourself too high. But Jail? Can someone be jailed for losing a civil case?

Truth doesn't seem to matter here, just damage to reputation. Go.com can come after me for claiming (truthfully or not) that they pass spam. comcast can have me arrested for claiming that they are one of the biggest spam networks that affect my systems.
