Yeah well, as someone outside the US I would hesitate to do anything.
I just have this view of the United States as a really scary, litigious
place where you could get sued just for standing still somewhere.

Doubt you would be charged unless you did some real damage.
The thief can always turn around and sue you, however, its going to be
hard
to make a case work if he was fleeing the scene of a crime that he had
committed.
