The report didn't mention that he explained it to his teacher. Maybe he did, but I'm assuming he didn't because the report only says that he mentioned it to another student. That is what I base my reasoning on. If he did explain it to his teacher, I would agree with you.
Student: Hey dude my mom is gay
Student2: Blah blah
Student: Yeah I have like two moms for real, my mom is gay!
Teacher: What did you say?!
Student: My mom is gay
Teacher: Don't you ever use that word (in that context again) again! Off you go!
something like that.

I completely disagree. The kid was asked about his folks and he answered in
a non hostile way. Then the teacher went ballistic. It seems to me that the
ACLU was right on the mark here. It seems to me that the only one who had
the problem was the teacher.
