Everything you buy from a local retail store has GST on top of it, doesn't it - and it doesn't matter where it comes from (Well, besides maybe a few exempted products depending on specific rules in AU).
A rather often ignored fact - if one downloads software from overseas for a business purpose one'd get it GST free (usually). If you want to be compliant with GST legislation in AU and NZ and your purchase is over a certain threshold you'd have to declare this "import" (virtual import) at customs and pay GST on it. It's very similar to when one goes overseas and brings back a box of CS 5.5 from the US or anywhere else. The person would have to declare it, pay customs/duty (if applicable - and THAT is where a FTA comes handy) and pay GST on import. Anything else is technically tax-evasion. Downloading a virtual good and using it domestically is not treated any differently from importing a physical good. Cheers Kai > Would GST even be applicable?
