Somebody's already been selling 'em on EBay. And I never said legal action should be brought against anyway... I merely said it wasn't a bright idea to discuss it in a public forum where Cisco people were at.
As for discouraging the program, I hardly think this would do it. You don't see people cloning ATM boxes, or VoIP stuff, do ya? So the argument of this is a cost-effective marketing tool for the CCIE program hasn't historically been a problem. *shrug* If people want to do it, they'll do it. However, I don't think it is advisable to discuss it publically, nor sell it. Whether to another person for "study purposes only" or whatever... Control gets lost after that. And you can get a 501 for the same price, if not less than the 16 meg card anyway, so what the hell is the point in building your own? It's not the price-point! I just cannot see Cisco taking legal action there. They have never been a legally heavy handed company. To take action in that case would send the wrong message. The CCIE program is one of their best marketing tools. It puts industry reconized experts in the field with a diffinite Cisco bias to them. The CCIE Security program is fairly new and I don't think it would be in their best interest to discourage it in any way.
