Yes you can load share - but it wouldn't load share any individual flow - I believe this ensures the order of packet arrival is correct.
If a link went down, I'm not sure about the packets in the interface queue (ie, those that had been placed on the outbound interface queue) but I would suspect they would be lost, so yes, you may lose a packet or two.
