If that's the only reason you need to distribute your code, then I'd
say that that is legitimate "Research Use" in the terms of Sun's
license, and you are permitted to release it provided it is
accompanied by a file that says that it hasn't been tested with the
JCK and that the recipient cannot deploy it for purposes other than
research without first getting certified by Sun.
In other words, if the transitive closure of all your users and their
users are all using the software for research, you can distribute it
freely and without payment or validation by Sun.
