There are a lot of people who know the "implications" of this. They are called lawyers (no, I'm not one nor do I shill for them). I suggest you ask one before you do it, especially since you've gone "public" with the fact that you know there may not be something kosher about doing this. And talk to one familiar with your state laws; they vary and so may your mileage.
