I talked to my sister-in-law who is a NWR mgr and she said that the feds
prefer that state wildlife officers handle these issues under state law.
Cobird contributors have mentioned intent as a necessary element of
violating the MBTA. I submit that putting a pressure washer in your hands,
causing the water to flow and aiming the water at the Cliff Swallow nests
constitutes intent. Being stupidly oblivious to the obvious activity around
the nests would not be a defense.
