No. It IS a conceptual problem. 
That is not how Cocoa apps work. 
Don't try to fight the frameworks or do something that users won't expect 
because apps don't work like that on OS X. 
Find a different way that fits the platform. 
If you need a menu in your modal window use an NSPopUpButton
