In my testing with the immutable bit on Snow Leopard 10.6.2, I get a dialog when I try to trash the item, not just when I try to empty the Trash. Of course, the dialog allows me to proceed, anyway. If I just try to move the item, the Finder insists on copying it, instead. Even holding down Command, which would normally force a move operation, doesn't allow it to be moved.
