This has nothing to do with the example, it's a common error message, when having the XML declaration not as the absolutely first thing in the XML file. There must not be any whitespaces or other characters in front of the XML declaration and it has to be in the form as at http://www.w3.org/TR/REC-xml#sec-prolog-dtd. Watch for case-sensitivity too. Have a look in all the related files to fix the bug.
