Hello all. I was referred to this group for advice on land use agreements. I've been working with a group of 25 people in NW Dallas, TX to start a community garden on a piece of property owned by Dallas Independent School District. The principal of the school fully supports the project and really wants to see it happen. However, we are running into some red tape with the district getting the land use agreement signed. Please see the update I sent the garden group recently. Any advice and ideas are welcome.
---------------------------------------------------------------------------- ----------- We met with several representatives of the DISD Facilities team on 10/31 and presented our site plan. We had a discussion with DISD about some of the issues that require them to involve the legal department and contracts team. 1. Liability - how to handle if someone is injured or DISD property is damaged? 2. Insurance - typically they require all their long term contract participants to have insurance. Obviously, we don't. 3. Responsible party - the contract needs to be with an organized "group" not an individual. Obviously, we are not organized to that extent yet. I asked them to please consider how we could make this happen, given we are not fully organized, have no insurance, nor are we a typical client. They indicated they thought some agreement would be still be possible. They will discuss our proposal, wish list and site map to their legal/contracts team the week of 11/17. I hope to get an update soon. In a previous meeting, Mike Brown had indicated that DISD would be willing to match funding and labor for the garden. This was unsolicited and I was thrilled at the offer, but skeptical about whether or not that would really happen. In this meeting, that funding offer was rescinded by another member of Mike's team. I believe the offer to help with labor may still be open. So that's where we are for now. The land use agreement must get signed before we can do anything more. What I could really use is creative thinking, energy and support from you about how we might support getting the land use agreement signed. Thank you!
