so it's frequent that:

there is a ko
you're out of ko threats
you're out of dame
you're playing japanese rules, and don't have a move other than pass

why not just have the "almost never gets evaluated as true" conditional
deep inside routines where: (is a ko) & (no valid moves that increase
winning percentage)

check for ruleset, behave appropriately.
