Karsten, I think you should contact the EMO IP team. They will be able to review and decide on a case by case basis. Either email or open a CQ.
FWIW, I think the contribution is still fine. It was contributed at time X and the contributed had an ECA on file at time X. The Gerrit/Git hooks don't seem to handle that case very well.
