Authorities converge on site of tree protest in Santa Clarita

SANTA CLARITA, Calif.(AP) - A developer trying to get a 400-year-old oak tree out of
the way of

a road-widening project turned up the heat on the tree-sitter trying to protect it, 
charging
him with trespassing and shooing away his supporters.

Private security guards, accompanied by California Highway Patrol officers and Los
Angeles County sheriff's deputies, served tree-sitter John Quigley with a trespassing
lawsuit on Thursday. Supporters sleeping below the tree were ordered to clear the area,
and a chain-link fence and "No Trespassing" signs went up around the oak.

Bill Rattazzi, president of the Los Angeles division of John Laing Homes, said no
attempt was made to remove or arrest Quigley.

"These actions were taken to stabilize the situation and allow the issue to be decided 
in
the courts in an orderly manner," he said.

Laing, which owns the property the tree sits on, wants it out of the way to widen a 
road
that would serve the proposed 21,600-home Newhall Ranch development north of Los
Angeles.

The company has offered to relocate the tree, but Quigley and other environmentalists
don't believe it can survive being moved.

Thursday's action gives Quigley 30 days to explain why he should be allowed to remain
in the tree. He does not have to appear in court.

"Talk about overkill," Quigley said by phone from the tree. "They sent in this military
operation to put up a fence."

Authorities also took away his tent.

Quigley, 42, had been scheduled to be replaced by another tree-sitter Thursday so he
could return to his teaching job and spend more time with his elderly father. But he 
said
he'll stay put now.

Rattazzi said the company acted in part because of complaints from neighbors.

The tree has drawn a steady stream of visitors since Quigley climbed it Nov. 1, 
including
folk singers, celebrities, tourists and schoolchildren.

On Thursday, about a dozen supporters yelled encouragement and sang the national
anthem as workers took away an American flag and children's artwork that had been left
behind.

The guards left the legal papers in a yellow ribbon that supporters had tied around the
old oak, said activist Jeff Johnson, who had been scheduled to take Quigley's place.

The tree-sitter has a metal lock box he can use to secure his arms around the oak to
keep from being forcibly removed. He has enough food and water to last at least a
week.

The activist, who lives on a platform in the tree, has rarely left his perch since 
arriving
more than two months ago. He did come down on Election Day to vote.
