Former Energy Dept. Intelligence Chief, Notra Trulock, Seeks Govt. Records Under Privacy & Freedom of Information Acts

Trulock Sounded the Alarm Over Nuke Security Breach at Los Alamos National Laboratories


(Washington, DC) Judicial Watch, the public interest group that investigates and prosecutes government corruption and abuse, said today that the Honorable Emmet G. Sullivan, of the U.S. District Court for the District of Columbia, has directed the Central Intelligence Agency (CIA) to deliver copies of documents sought by Judicial Watch client and former Energy Department Director of Intelligence, Notra Trulock, under the provisions of the Privacy Act and the Freedom of Information Act, for in camera review.

In a “Memorandum Opinion and Order,” dated March 31, 2003, Judge Sullivan wrote: “The Court is indeed persuaded that the CIA has not provided sufficient information through affidavits and descriptions of the documents fully and partially withheld to permit the Court to rule on the CIA’s claims of statutory exemptions. . . Accordingly, the Court shall direct defendant CIA to submit all documents withheld in whole or in part for in camera review, to enable the Court to ascertain whether the claimed exemptions apply.” The opinion is available on the Judicial Watch Internet site at: www.JudicialWatch.org

Mr. Trulock, the national security hero who sounded the alarm over the biggest breach of nuclear security since the Rosenbergs, at Los Alamos National Laboratories, is pursuing a number of legal actions in order to seek justice for an unlawful smear campaign directed against him by Clinton administration officials, former FBI Director Louis Freeh, and the now thoroughly discredited FBI. Trulock’s First Amendment rights were violated by Freeh and other FBI officials when, after Trulock wrote an article critical of the FBI, they ordered his personal computer files by seized by FBI agents. The FBI neither had a warrant nor the consent of Trulock or his landlord to conduct the illegal search and seizure. Recently, the Fourth Circuit Court of Appeals allowed a civil rights complaint by Trulock against former FBI Director Louis Freeh and others to proceed. The deposition of Freeh is tentatively set for May 23, 2003.

“We are encouraged by Judge Sullivan’s order and are confident that Mr. Trulock will prevail in having the government turn over the records and files it maintains on him. Honorable, honest citizens, such as Mr. Trulock, should not be the subject of secret government files and coordinated government efforts to thwart transparency and accountability,” stated Judicial Watch President Tom Fitton.
