--- Begin Message ----Caveat Lector- http://www.haaretzdaily.com/hasen/spages/374289.htmlSun., December 21, 2003 Kislev 26, 5764 Sharansky awarded NIS 900,000 damages for libelous book By Yuval Yoaz, Haaretz Correspondent, and Haaretz Staff Jerusalem District Court on Sunday awarded Minister Nathan Sharansky some NIS 900,000 in damages for libelous charges made in the book "Sharansky Unmasked," by Dr. Yuli Nudelman. In August 2002, Jerusalem District Court Judge Zvi Segal ruled that the book included libelous charges against Sharansky and his then party, Yisrael b'Aliyah. The ruling upheld a libel suit brought by Sharansky and the party against Nudelman. The suit was originally filed over two years ago, by attorney Dan Avi-Yitzhak. Nudelman was represented during the final stages of the trial by attorneys Yoram Muscat and Sharon Spint. The suit centered around certain quotes used by Nudelman in his book, in which sources in the former Soviet Union accused Sharansky of acting as an intelligence agent for the United States, the Soviet Union and Israel. In addition, there were several references to claims that Sharansky covertly represents the Palestinian and Arab interest. The book also claimed that Sharansky's strength is a result of his ties with criminals he met during his incarceration in Soviet labor camps and prisons. The book also quotes sources as saying that Sharansky cooperated with the Soviet authorities and the KGB during his time behind bars, that he nurtured his ties with them even after immigrating to Israel and that both he and his Knesset party have connections with the Russian mafia. In his ruling, Judge Segal said that Nudelman had not produced a single shred of evidence to back up these claims, and that even though many of them were portrayed as rhetorical questions or used indirect phrasing, there was no mistaking the libelous character of the claims. Segal also pointed out that Nudelman had not even proved the existence of a Russian mafia in Israel, nor who was alleged to be a member of this mafia. The author of the book did prove, on the other hand, that businessman Grigori Lerner donated NIS 300,000 to the Olami foundation of which Sharansky was head. He did not subsequently prove, however, that Lerner was a member of the Russia mafia, despite the fact that he has been convicted of fraud and is currently behind bars. Segal ruled that Nudelman's libelous claims not only harm Sharansky, but also the political party of which he is chairman, since Sharansky is very closely associated with the party. Segal added that in addition to the indirect libel of Yisrael b'Aliyah, Nudelman also directly slandered the party by claiming that it is the vehicle by which the Russian mafia has tried to infiltrate the Knesset. Pointing out that the book was published in 1999 - just months before the elections for Knesset - Segal said that this reflected on Nudelman's intent to damage the party's chances. The judge also said that, in his opinion, even Nudelman himself did not believe the libelous claims he was making.
