-Caveat Lector- Senate Gun Bill Conferees Appointed Source: nealknox.com Published: Wed, 28 Jul 1999 13:27:18 -0400 Author: Neal Knox July 28 update -- The Senate this morning slapped down Sen. Bob Smith’s (I- N.H.) plea to uphold the Second Amendment, ended his filibuster on substituting the gun-provision-laden Senate Juvenile Justice bill for the gun-free House version, and appointed conferees who support the bill. The vote to shut off debate passed 77-22; 25 had originally voted against the bill, so gunowners lost ground. With the result of the rest of Majority Leader Trent Lott’s motion to send the bill to conference a foregone conclusion, Sen. Smith allowed it to pass by unanimous consent. The Senate conferees are Sens. Orrin Hatch (R-Utah), Strom Thurmond (R- S.C.), Jeff Sessions (R-Ala.), Patrick Leahy (D-Vt.), and Edward Kennedy (D- Mass.). All of them voted for final passage S. 254, the Senate bill, though some had voted the NRA position on most of the gun provisions. Sen. Larry Craig (R-Idaho) stood with Sen. Smith during a hour-long discussion of the merits of the House and Senate bills, but in a quirk of the Senate rules, the debate occurred after the vote. Sen. Dianne Feinstein (D-Calif.), who advocated rapid acceptance of the Senate bill “before the students of Columbine return to school in August,” called for the conference committee to restore her ban on imports of all over- 10-round magazines. The House Parliamentarian had declared the Senate-approved magazine ban affected customs revenue, and therefore in violation of the Constitutional requirement that all revenue measures originate in the House. The House had concurred and sent S. 254 back to the Senate for correction. That provision was left out of today’s Senate substitute for the House bill. However, there is no question that the magazine ban will be in the Conference version for the same provision passed the House by voice vote, and passed the Senate 59-39. Sen. Feinstein said both Speaker Dennis Hastert (R- Ill.) and Judiciary Chairman Henry Hyde (R-Ill.), who sponsored it in the House and will certainly be among House conferees, had pledged their support. While Speaker Hastert has proposed that other gun provisions which passed both houses by wide margins also be included such as the requirement to sell a trigger lock with every handgun, and the bans on sales and possession of certains guns by juveniles. The Speaker has also proposed that there be a compromise between the House-approved Dingell gun show amendment, which would give the FBI up to 24 hours for an “instant check” and the Senate-passed Lautenberg amendment, which would allow up to three business days. President Clinton has huffed that if the present gun laws are weakened, as he says the Dingell amendment would do, that he would veto whatever comes out of conference. Odds are, as I wrote back in May, the final bill won’t include any gun show provision. The Democrats want to use background checks at gun shows as a campaign club against Republicans although most Republicans and NRA have endorsed such checks. Sen. Smith made a passionate speech pleading with Senators to uphold the Constitution, including the Second Amendment. It fell on deaf ears. He said he was disappointed by his supposedly conservative, supposedly pro-gun colleagues. So was I, and so were their gun-owning constituents.
