Marshals ready if needed for Elian

WASHINGTON, April 17 (UPI) -- The Justice Department has developed a variety
of plans to enforce the law in the Elian Gonzalez case.

Sources told United Press International Monday that under one plan U.S.
marshals would protect immigration agents if they had to forcibly remove the
6-year-old from the home of Miami relatives who are refusing to give him up.
The marshals would be necessary because of the crowds surrounding the Miami
home.

Members of the Cuban-American community in Miami have vowed to resist any
attempt to physically remove Elian from his Miami relatives.

But one official said the department is remaining flexible, not committing
itself to any one course of action, until the end of the federal appeals
court process.

The Miami relatives, headed by Elian's great-uncle Lazaro Gonzalez, have
asked the appeals court to order the Justice Department not to transfer
Elian's custody to the boy's father, and not to let Elian be removed from the
United States, until the relatives' battle to keep the boy is exhausted in
the federal courts.

In response, the Justice Department has asked the appeals court,
headquartered in Atlanta, to order the Miami relatives to surrender the boy.
In return, the department has promised to use its power under federal
immigration law to prevent Elian's departure from the United States.

Officials said Monday that the marshals would only be used if, as expected,
the Miami relatives lose their federal appeal and still refuse to turn over
the boy.

Elian's mother and at least 10 other Cubans drowned at sea when they fled
from Cuba to the United States in November. Elian, one of three survivors,
was rescued off Florida on Thanksgiving Day.

In January, the Immigration and Naturalization Service ruled that the boy's
Cuban father, Juan Miguel Gonzalez, was the only one who "could speak" for
Elian in immigration matters.

Juan Miguel, his current wife and their 6-month-old son flew from Cuba to
Washington earlier this month, and have been living in the vacated home of a
Cuban diplomat. Juan Miguel continues to ask that his son be turned over to
him, but has promised not to return to Cuba with him until the Miami
relatives exhaust the appeals process.
