'Gay' sex gag order amended Judge allows media to discuss controversial homosexual workshop ------------------------------------------------------------------------------ -- By Julie Foster © 2000 WorldNetDaily.com A gag order banning the discussion of a recorded meeting in which Massachusetts State employees explicitly described homosexual sex acts to teenagers was amended yesterday allowing media outlets to report on the controversial tape recording. As reported by WorldNetDaily, Scott Whiteman attended a "Teach-Out" conference on March 25, sponsored by the Gay, Lesbian and Straight Educational Network, or GLESN, at Tufts University where he secretly audio-recorded a workshop titled, "What They Didn't Tell You About Queer Sex & Sexuality in Health Class: A Workshop For Youth Only, Ages 14-21." When Whiteman publicized the graphic nature of the workshop -- part of Massachusetts' Safe Schools program -- one of the state employees running the workshop and a 17-year-old student participant filed for the gag order. Drafted by the plaintiffs' lawyers at Gay and Lesbian Advocates and Defenders and signed by a superior court judge, the original language of the ruling precluded media reports of the recording, prompting involvement by the Fox News Network. The network filed a "Motion to Intervene," claiming the gag order was "unconstitutional prior restraint." According to Massachusetts News, no other media outlet protested the gag order. Whiteman, a member of the Parents Rights Coalition, was represented by Chester Darling at a hearing Tuesday. At the hearing, GLAD requested the order be revised to exempt the media. Judge Allan van Gestel, who altered the order, responded to the plaintiffs, saying an exemption for the media would effectively defeat the purpose of the gag order. Whiteman, the Parents Rights Coalition "and any persons in active concert or participation therewith" are still bound by the order. The order was granted on the grounds that the recording was made illegally. "Interception" of communication without notification of participating parties is prohibited. Darling argued for the judge to remove all restraints from his clients on First Amendment grounds. Even if they did violate a wiretap law in recording the conference, there is no provision in the law for issuing an injunction against speech, only for monetary damages, Darling said. "Scott Whiteman heard and saw the entire workshop," Darling argued, according to Massachusetts News. "He has an unfettered First Amendment right to describe, talk about or write down what he personally heard and saw. He did not 'secretly hear' what was going on at the workshop. He was there; he paid an admission fee; he witnessed it. He read materials and matter which were distributed there, disseminated to minors and available to him. ... It burdens too much speech." GLSEN's webpage states, "Unless otherwise specified, events are by invitation only." The activist organization claims all participants at the "Teach-Out" had to agree to a policy of confidentiality. The conference was only for "registered" participants, GLSEN insists. But Parents Right Coalition President Brian Camenker argues it was a public event, open to anyone who wanted to attend. Whiteman registered under his own name and paid his fee. According to Camenker, the idea of any confidentiality requirement is a fabrication. "There was nothing told, either verbally or in print in any of the literature surrounding the event about not tape recording it. There was absolutely nothing about this -- and believe me, we've been through absolutely everything," Camenker said. The judge called the secret taping "disgusting behavior" at the hearing, saying he was "deeply offended" by Whiteman's actions. Darling shot back, "I'm deeply offended by what was told to those children. It was a crime; it has to be revealed." Massachusetts News, which has extensively reported on the conference and the firestorm that followed, spoke with Whiteman after Tuesday's hearing. "We do know that there were criminal activities occurring at the hands of GLSEN. We suspected this has been occurring for years and we have been reporting to the Department of Education since December. Our reports have been laughed at. In fact, I received two letters from a member of the Board of Education trivializing my complaints, basically saying that since nothing ever goes wrong, parents have no right to intervene." Asked what kinds of laws were violated at the workshops, he answered, "Lewd and lascivious corruption of youth, inducing a minor for sexual intercourse, enticing a minor to commit sexual intercourse. It's a nightmare, all the various statutes. There is a whole consortium of them."
